Rental Terms and Conditions

A. General Conditions:

1. Capacity and Age: La Collina di Cesare accommodates a maximum of 14 guests (with a maximum of 10 adults and 4 children). The minimum age to rent the villa is 21 years.

2. Rates:

All published rates are weekly rates, from Saturday/Saturday. Published rates include a weekly cleaning (within reasonable limits), use of utilities (reasonable use), use of bed linen and tourist tax.

No extra booking or administrative charges are added when booking through our official website (www.lacollinadicesare.com).

3. Reservation Process:

Reservation requests can be made via the form on our website or by email. When making a reservation request, please provide the full name, age and address of all guests (including the children) and a copy of the ID card of the designated head of the group (this is a requirement under Italian law). By sending the reservation request, the interested Tenant confirms to have read and accept the present Rental Terms and Conditions.

4. Check-in and Check-out:

Official check-in is from 4:00 PM (CET), and check-out is by 10:00 AM (CET). Other times may be requested, but are subject to availability.

The keys will be collected on arrival and deposited back on departure at a location indicated by La Collina di Cesare.

If the keys were taken by mistake by the Tenant, La Collina di Cesare must be notified immediately. The keys will then be returned as soon as possible by express and registered courier service.

5. Acceptance of the property:

Complaints must be reported to La Collina di Cesare within 24 hours of arrival at the property. If justified and possible, La Collina di Cesare will remedy the situation within the shortest possible time.

The pictures and floor plans on the website and/or on any booking sites are only indicative (including but not limited to the exact layout and the scale and dimensions).

B. Payment and security:

1. Deposit and payment terms:

A 25% deposit is required within 7 days after the reservation is confirmed by La Collina di Cesare. The remaining balance (75%) is due no later than 6 weeks before your arrival. For reservations made less than 6 weeks in advance, the full amount is due within 7 days after the reservation is confirmed by La Collina di Cesare and in any case before the start of the rental period.

2. Payment Details:

Bank account details for payments will be provided upon confirmation of the reservation. Only bank transfers are accepted, whereby all costs related to bank transfers are to be incurred by the Tenant. Payments by credit card are not accepted.

3. Security:

A security of EUR 750 is due when the remaining balance of the rental price becomes due. The security serves in the first instance to cover any costs as a result of direct or indirect damage caused to the property or its contents. Furthermore, it can be invoked to cover the claims of La Collina di Cesare as a result of the Tenant’s non-compliance with the rental conditions. The security can also be invoked to cover any excessive use of utilities and/or theft. The security can at no time be regarded as part of the payment of rent or advance payment thereon.

In the event that the security proves to be insufficient for the damage suffered, La Collina di Cesare can still demand additional compensation from the Tenant.

The security will be refunded (less any charges for damage, non-compliance with the rental conditions or any excessive electricity consumption) within 3 weeks after your stay. Refund of the security does not automatically imply an acknowledgment by the La Collina di Cesare that no damage has been caused to the property.

C. Cancellations:

1. Cancellation by the Tenant:

In case of cancellation 90 days or more prior to the start of the rental period, 100% of the paid amounts will be reimbursed.

In case of cancellation less than 90 days and more than 6 weeks prior to the start of the rental period, the deposit remains acquired by La Collina di Cesare.

In case of cancellation 6 weeks or less prior to the start of the rental period, 100% of the rental price will be due and/or remains acquired by La Collina di Cesare.

Failure to make the required payments by the due dates is considered a cancellation by the Tenant.

In case of a cancellation, La Collina di Cesare immediately becomes free to re-let the property for the period in question.

2. Cancellation by La Collina di Cesare:

If due to unforeseen circumstances La Collina di Cesare is forced to cancel the reservation, no compensation will be owed, and any amounts paid by the Tenant will be refunded.

D. Household and Property Rules:

1. Housekeeping:

Guests are expected to leave the property tidy and in good condition, with no dirty dishes, and empty the fridge, dishwasher, and trash bins. The barbecue must be cleaned after each use.

In case additional cleaning is required besides the normal cleaning, this will be deducted from the security.

Household waste, plastic and paper must be sorted in the bags provided by the municipality and put at the Tenant’s disposal by La Collina di Cesare (residual waste, plastic, paper) and then collected in the 3 waste containers placed at the gate of the property. All glass must be brought by the Tenant to the glass containers available in the center of Calosso.

2. Swimming Pool:

The swimming pool is unguarded and use of the swimming pool is at the Tenant’s own responsibility. In the event of an accident, La Collina di Cesare can never be held liable.

Access protection for children and inexperienced persons is provided by means of a fence, but it belongs to the responsibility of the Tenant to keep the fence closed.

In view of the depth of the swimming pool (1m20), it is not allowed to dive into the pool.

The pool is maintained by a professional who visits regularly according to his own schedule and who must be granted access.

3. Granting access:

The Tenant is obliged to grant access to persons such as handymen or cleaning staff or others who are responsible for the maintenance and insurance of the proper functioning of the property and swimming pool.

E. Property Usage and Responsibilities:

1. Use of Facilities:

The house is for residential use only.

The Tenant is not allowed to sublet partially or completely the property without the permission of the landlord. Visitors and permitted sub-tenants must be informed of the terms and conditions and the Tenant bears all responsibility for them. Under no circumstances can visitors or sub-tenants be offered accommodation that exceeds the normal capacity of the house. Overnight stays of third parties in a motorhome, tent or other sleeping accommodation are not allowed.

2. Wind, Rain and Animals:

Shutters, awnings, parasols, and any other items must be secured against sudden increases in wind and/or rain.

Food should not be left outside if you are not in the garden or leave the property.

3. Noise and Quiet Hours:

We kindly ask Tenants to respect the tranquility of the area.

Between 10 pm and 9 am, no noise is allowed that extends beyond the immediate surroundings of the domain.

4. Use of Electricity:

There is a public electric charging station for motor vehicles in the center of Calosso (a 2 minutes’ drive or a 15 minutes’ walk, https://maps.app.goo.gl/GcuzKbUdk1Cn8fFNA).

It is strictly prohibited for Tenants to charge their hybrid or electric vehicle(s) at the property.

The “normal” use of electricity is included in the rental price. In case of excessive use (e.g. due to an excessive use of the heating or air-conditioning system while leaving the doors or windows open), we reserve the right to request an additional fee to cover these extra costs. These costs will be deducted from the deposit.

5. Damage and Loss:

The Tenant is liable for all losses and/or damages that arise for La Collina di Cesare, including but not limited to losses and damages to the building and the garden (including their contents) and/or to any third party, as a direct or indirect consequence of the Tenant’s stay. Costs include the costs associated with interventions of third parties (such as a property manager, keyholder, technician, police officers, the fire brigade, etc.) and/or any collection costs. This is regardless of whether these losses/damages were caused by themselves or by third parties present at the property at the Tenant’s initiative.

La Collina di Cesare suggests the Tenant to take out his/her own insurance that covers any such costs and damages.

After the stay, the household belongings may not show any signs of wear other than those acceptable for normal use.

Any damage or loss must be reported immediately to La Collina di Cesare.

F. Miscellaneous Provisions:

1. Barbecue and Open Fire:

Due to fire hazards, open fires with wood or charcoal are prohibited, except for the provided barbecue. The barbecue must always be attended to with a bucket of water on hand.

2. Indoor fire place

The indoor fire place in the leisure room is not operational and cannot be used at any time.

3. Septic and Drainage Systems:

Under no circumstances may the Tenant throw items into sinks, baths, showers or toilets that could clog the drainage system or fall outside the daily intended use of these installations. The correct cleaning products are normally present. When purchasing your own cleaning products, make sure that they are suitable for septic tanks. Unclogging products (destop) are not allowed. In any case, do not use “Bleach” or “Eau de Javel” as they may affect the bacteriological activity of the septic tank.

G. Pets and Smoking:

1. Pets:

No pets are allowed.

2. Smoking:

Smoking (including vaping, e-cigarettes, etc.) is prohibited inside the house.

H. Liability:

1. Liability of La Collina di Cesare:

La Collina di Cesare is not responsible for any loss, theft, injury or other events occurring during the stay in or around the property, including accidents involving the swimming pool or garden furniture.

2. Responsibility of Tenants:

The Tenant is responsible for the care of the property and for any damage caused by themselves, their visitors, or co-tenants, even if discovered after departure.

The alarm system and video camera protection system will be completely disabled during the stay and the Tenant will need to ensure to always properly close all doors and windows when leaving the property.

I. Applicable law and competent court:

1. The Tenant agrees that all disputes between the Tenant and La Collina di Cesare regarding these rental terms and conditions are exclusively subject to Belgian law, excluding any conflict of law principles.

2. Every dispute regarding these rental terms and conditions should be submitted to the exclusive jurisdiction of the courts of Leuven, Belgium, excluding any other court.
